1. Acceptance of Terms
By accessing and using Manifestare ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Service Description
Manifestare is a comprehensive business platform that provides website building, marketing tools, analytics, and development support services ("Dev-on-Demand") to help businesses establish and grow their online presence.
3. Dev-on-Demand: Development Support Service
3.1 What Dev-on-Demand Is
Hands-on help from our in-house developers and designers to set up, fix, and optimize anything inside the platform's goals (site, forms, email, social scheduling, analytics). Each tier includes a set amount of Dev Hours and fair-use limits.
3.2 What's Included (Typical Tasks)
Site & SEO:
Theme setup, page layouts, navigation, redirects, metadata, schema, performance passes.
Forms & Data:
Form builder, validations, spam protection, file uploads, list routing, webhooks.
Email & Automations:
Domain auth (SPF/DKIM/DMARC), list import (opt-in only), segments, journeys, templates.
Social Scheduling:
Account linking, content queues, calendar setup, UTM rules, basic inbox wiring.
Analytics:
Event/install script, goals, UTM governance, dashboards, cohort/ROAS views.
Migrations (Light):
Import content/assets from your old site or email tool (format permitting).
QA & Fixes:
Broken layout, mobile issues, failed forms, DNS gotchas, deliverability nudges.
3.3 What's Not Included (Requires a Quote)
- Custom software / apps / APIs outside native features (e.g., bespoke booking engine, custom React apps)
- Third-party platforms not officially supported (we'll advise; deep work is quoted)
- Complex data work: multi-system migrations, custom ETL, historical analytics stitching
- Original brand design beyond included templates (full logo systems, brand books)
- Ongoing content production (e.g., writing 20 blog posts/month, daily video editing)
- Ads management (Google/Meta), legal/compliance reviews, regulated workflows
- Enterprise security & IT beyond our controls (SSO/SAML rollout, device/MDM policies)
If a request is too big or outside scope, we'll send you a fixed quote (or discount bundle) and only proceed with your approval.
3.4 How Dev Hours Work (Per Tier)

Micro tasks (≤30 minutes): Quick fixes (copy, colors, small CSS, link, DNS record).
Standard tasks (≤2 hours): New page from template, form + list + automation, social calendar setup, analytics goal wiring.
Over 2h or multi-week: Quoted project.
Hours do not roll over. We'll help you break work into standard chunks to maximize value.
3.5 SLAs & Fair Use
Intake: We acknowledge new requests within 1 business day; emergencies (P0: site down, forms not submitting, email auth failure) jump the queue.
Work cadence: Tasks are completed in the order received; we may limit to one active task per brand on Launch, two on Grow, three on Scale to keep things fair.
Revisions: Up to 2 minor rounds per task; larger changes may require re-scoping.
Access: You provide timely approvals and access (DNS, domain registrar, brand assets, email lists with opt-in proof). Delays pause the clock.
3.6 Founding Members: 60-Day Unlimited Dev-on-Demand
Goal: Get you fully live and successful as a tester—fast.
What "unlimited" means (for 60 days):
- We waive Dev-hour limits and prioritize your requests for two months
- We will design and build what you need to get live on the platform at your tier's access level
- One active task at a time per brand, unlimited submissions, rapid iteration
Includes: Site setup, core pages, 1–2 funnels, forms, email domain auth, 2–3 automations, social calendar for the first month, analytics dashboards, light content migration.
Does not include (still quoted): Custom apps/APIs, heavy migrations, non-platform deliverables (mobile apps, custom backends), large content production, advanced brand identity work, or ad-buy management.
After day 60: You revert to your tier's monthly Dev Hours. Anything still in flight continues under quoted scope or your tier allotment.
3.7 Quote & Change-Order Process
We classify your request (Micro / Standard / Project).
If Project: you get a fixed quote (price, timeline, deliverables).
Approve in-app to start. We won't begin quoted work without your OK.
Scope changes trigger a quick change order (no surprises).
Reference rate (outside included hours): $100/hr, with bundle discounts (5h $499; 10h $899; 20h $1,699). Use included hours first; buy bundles only if needed.
3.8 Examples

"Set up a lead magnet funnel: landing page (template), form → list, 4-email nurture, socials scheduled for 2 weeks with UTM rules."

❌ Quoted Project:
"Build a custom job board into my site." "Migrate 10k posts from five systems and normalize analytics."
❌ Out of Scope:
"Run my Google Ads and write 20 blog posts/month."
4. Subscription and Billing
4.1 Subscription Plans
We offer multiple subscription tiers (Launch, Run, Scale) with monthly and yearly billing options. All prices are listed in USD and exclude applicable taxes.
3.2 Automatic Renewal
Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription fee.
3.3 Payment
Payment is due at the beginning of each billing period. We accept major credit cards through our secure payment processor, Stripe. You authorize us to charge your payment method for all fees incurred.
3.4 Refunds
We offer a 30-day money-back guarantee for new subscriptions. Refunds for subsequent billing periods are at our discretion. Founding Member pricing is locked in for the duration of your continuous subscription.
5. Account Responsibilities
5.1 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
5.2 Acceptable Use
You agree not to use the Service for any unlawful purposes or to conduct any unlawful activity, including but not limited to:
- Violating any applicable laws or regulations
- Infringing on intellectual property rights
- Distributing malware, spam, or harmful content
- Attempting to gain unauthorized access to our systems
- Using the service to compete directly with Manifestare
6. Service Availability and Support
6.1 Uptime
We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance when possible.
6.2 Dev-on-Demand Support
Development support is provided based on your subscription tier and is subject to our support policies and response times. Support does not include custom development outside the scope of our platform features.
7. Intellectual Property
7.1 Our Rights
Manifestare and its original content, features, and functionality are owned by Manifestare and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
7.2 Your Content
You retain ownership of content you create using our Service. You grant us a limited license to host, store, and display your content as necessary to provide the Service.
8. Termination
8.1 Cancellation
You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period.
8.2 Termination for Cause
We may terminate your account immediately if you violate these Terms of Service or engage in activities that harm our Service or other users.
8.3 Data Retention
Upon termination, we will retain your data for 30 days to allow for account reactivation. After this period, your data may be permanently deleted.
9. Disclaimers and Limitation of Liability
9.1 Service Disclaimer
The Service is provided "as is" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
9.2 Limitation of Liability
In no event shall Manifestare be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.
10. Governing Law
These Terms shall be interpreted and governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through our Service. Continued use of the Service after changes constitutes acceptance of the new Terms.
